SIDA threatens lawsuit against Destiny USA

SYRACUSE, N.Y. -- A threatened lawsuit by the Syracuse Industrial Development Agency against Destiny USA is over before it began.
SIDA claimed that, as part of an extension on a project deadline, Destiny had agreed to phased payments of $4 million from an escrow fund. Now that the project is halted, Destiny claims it should only transfer $2 million.
SIDA said it would sue for non-payment, but Destiny has now delivered the payment due for this month.
The company said in a statement, "We actually offered to make this payment as part of discussions we attempted to have with SIDA in recent days on what they believed to be outstanding issues. Unfortunately, SIDA was not interested in discussing the matter and for whatever reason unexplainably felt the need to act in a matter of hours."
SIDA says it will drop any plan for a lawsuit, for the time being.
Destiny says it is studying its legal options.
