OSWEGO COUNTY, N.Y. -- A lawsuit filed after two Southern Tier men drowned in the Oswego River when the water levels rose back in 2010 is now settled. Clifford Luther of Horseheads and Leonard Nichols of Wellsburg were swept away while fishing after a release of water from the Varick Dam and Hydroelectric plant in September 2010.

The question that caused a lot of controversy, though, was whether the siren went off before the water rose to alert the fishermen. Brookfield, the plant's owner, says a siren did sound, but the lawsuit claimed it did not sound at the proper time.

The case was settled for $1.8 million, $950,000 to Luther's family and $850,000 to Nichols' family. The lawyer who represented the families says his clients thank Brookfield for the straight-forward and compassionate way they addressed the claims.
